1. Acceptance of Terms
By creating an account or using SmartPost ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and SmartPost.
2. Description of Service
SmartPost is an AI-powered content generation and social media automation platform that allows users to create, schedule, and publish content across multiple social media platforms including Telegram, Twitter, LinkedIn, and others.
3. Account Registration
You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 16 years old to use this Service.
4. Acceptable Use
You agree not to use the Service to:
- Generate or publish spam, misleading, or deceptive content
- Violate the terms of service of any connected social media platform
- Infringe on any intellectual property rights
- Harass, abuse, or harm any individual or group
- Attempt to circumvent usage limits or access controls
- Use the Service for any unlawful purpose
5. Subscription and Billing
The Service is offered on a subscription basis. Free plan features are available indefinitely. Paid plans are billed monthly or annually as selected. All payments are processed securely by Stripe. Prices are listed in USD and may be subject to applicable taxes. Subscriptions auto-renew unless cancelled before the renewal date.
Refunds are handled on a case-by-case basis. Please contact support within 7 days of a charge if you believe a refund is warranted.
6. Content Ownership
You retain all ownership rights to content you create using the Service. You grant SmartPost a limited license to process your inputs solely to provide the Service. We do not claim ownership of your generated content or use it to train AI models without your explicit consent.
7. AI-Generated Content
Content generated by our AI tools is provided for your use. You are solely responsible for reviewing and approving all content before publication. SmartPost does not guarantee the accuracy, completeness, or fitness of AI-generated content for any particular purpose.
8. Platform Credentials
When you provide social media API credentials or tokens, they are encrypted and stored securely. You are responsible for ensuring your use of those credentials complies with the respective platform's terms of service.
9. Service Availability
We aim for high availability but do not guarantee uninterrupted service. We may suspend or terminate the Service at any time for maintenance, security, or other operational reasons. We will provide reasonable notice where possible.
10. Limitation of Liability
To the maximum extent permitted by law, SmartPost shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the three months preceding the claim.
11. Changes to Terms
We may update these Terms at any time. We will notify registered users of material changes by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
